MUSTAPHA SAKMUD’S REMARKS ON MA63 REPORT HIGHLIGHT THE NEED FOR GREATER TRANSPARENCY

KOTA KINABALU: Borneo’s Plight in Malaysia Foundation (BoPiMaFo) takes note of the statement by Datuk Mustapha Sakmud, Minister in the Prime Minister’s Department (Sabah and Sarawak Affairs), that the Final Report of the Special Cabinet Committee reviewing the implementation of the Malaysia Agreement 1963 (MA63) will remain classified under the Official Secrets Act 1972 and will not be disclosed to the public.

BoPiMaFo respectfully acknowledges that certain aspects of governmental deliberations may legitimately require confidentiality, particularly where national security or highly sensitive intergovernmental negotiations are concerned. Nevertheless, the implementation of MA63 concerns constitutional arrangements that directly affect the rights, interests and future of the people of Sabah and Sarawak.

For that reason, transparency should remain the guiding principle wherever reasonably possible.

MA63 is not merely a political understanding or an administrative framework. It represents one of the constitutional foundations upon which Malaysia was formed in 1963. Matters relating to fiscal rights, legislative powers, parliamentary representation, immigration autonomy and other constitutional commitments are issues of profound public importance.

The people of Sabah therefore have a legitimate interest in understanding the progress being made in fulfilling these constitutional commitments.

BoPiMaFo respectfully urges Datuk Mustapha Sakmud and the Federal Government to consider releasing, at the very least, a declassified executive summary or public progress report outlining the key issues examined, the decisions reached and the status of implementation of outstanding MA63 matters, while withholding only information that would genuinely prejudice national interests.

Such an approach would enhance public confidence, strengthen accountability and demonstrate a commitment to open and responsible governance.

BoPiMaFo further reiterates that the aspirations of Sabahans extend beyond administrative negotiations. Many continue to seek faithful implementation of the fundamental assurances that accompanied the formation of Malaysia, including effective security, equitable economic development, respect for constitutional safeguards and meaningful protection of Sabah’s constitutional rights and autonomy.

Constitutional rights arising from MA63 should not be regarded as political concessions or matters of executive discretion. They are solemn legal and constitutional obligations that should be implemented faithfully, transparently and in accordance with the rule of law.
