Sabah’s 40% Entitlement – Former MP expresses shock over the Court of Appeal’s decision 

SANDAKAN: Former Member of Parliament Chong Hon Min expressed shock, regret and strong dissatisfaction over the decision by the Federal Court of Appeal to grant the federal government a stay of execution on the High Court ruling regarding Sabah’s 40% net revenue entitlement. 

He described the decision as extremely unfair and unacceptable to the people of Sabah. 

The issue of Sabah’s 40% net revenue entitlement originates from constitutional arrangements made at the formation of the nation and is a legitimate right belonging to Sabah. 

However, this entitlement has remained unfulfilled for decades, severely affecting Sabah’s development & the well-being of its people.

The earlier ruling by the Kota Kinabalu High Court was meant to be a crucial step toward correcting this long-standing historical injustice.

Nevertheless, the Court of Appeal’s decision to allow a delay in enforcing the ruling once again pushes Sabah’s rightful claims into an indefinite wait. 

“This is not only to prolong the long-standing delay but also to undermine public confidence in judicial fairness & the integrity of the system.

“The people of Sabah firmly stress that justice must not be repeatedly delayed. Any form of postponement constitutes further harm to Sabah’s rights and runs counter to the principles of fairness, justice & the spirit of federalism,” he said.

In light of this, Chong calls for:

(1) The relevant authorities to review this decision to ensure that the spirit of justice is not weakened;

(2) The federal government to demonstrate sincerity in resolving Sabah’s 40% net revenue entitlement as soon as possible;

(3) An immediate end to all delaying tactics & to restore fairness as well as dignity to the people of Sabah.

The people of Sabah have waited for more than half a century and can no longer endure further unnecessary delays. Sabahans must continue to stand firm & speak out to defend their rightful entitlements.
