Confidence in the judicial process and continued support for Sabah Law Society and the Sabah state government

KOTA KINABALU: Let us remember that the judiciary is the cornerstone of justice and fairness in our beloved nation. The Federal Attorney General (FAG) possesses the essential right to appeal a judgment issued by a lower court to a higher court. 

Currently, the FAG is considering appealing the grounds of certain aspects of the High Court’s ruling to the Court of Appeal. 

Given the significant financial and constitutional implications for the Federal Government, it is imperative that the FAG approaches this process with sincerity, prudence, and thoroughness.

As citizens committed to justice and the rule of law, we place our unwavering trust in the integrity and sovereignty of our judicial system. 

We believe that the High Court’s decision was reached after comprehensive deliberation, grounded firmly in the Constitution and the rule of law. 

Respecting and supporting the judicial process is vital in our shared effort to uphold justice, ensure fairness, and safeguard the stability of our legal framework.

At this momentous moment, let us express our full support to the Sabah Law Society and the Sabah State Government, whose steadfast dedication to defending our constitutional rights is truly inspiring. 

Their unwavering resolve to protect Sabah’s interests and uphold justice for our people is of paramount importance. 

It is noteworthy that the Federal Government has chosen not to appeal the High Court’s decision regarding the constitutionality and the longstanding failure to fulfill Sabah’s rightful 40% revenue entitlement, a recognition of the Federal Government’s historical neglect and anomalies toward Sabah as a key partner in the Federation. 

We appreciate Prime Minister Anwar Ibrahim’s courage in asserting Sabah’s constitutional rights and placing them in their rightful perspective.

Should the Federal Attorney General proceed with the appeal on some parts of the High Court’sjudgment, and should the Court of Appeal uphold the High Court’s ruling, it will dispel any remaining ambiguities and reaffirm the legitimacy of this landmark judgment. 

Such an outcome will ultimately benefit the people of Sabah by clarifying and securing our constitutional rights to that 40% revenue entitlement, an essential condition of Sabah’s participation in the formation of Malaysia in 1963.

Throughout this legal journey, let us embody patience, understanding, and respect for the judiciary. Our hope remains high, rooted in confidence that the judiciary’s dedication to justice—guided by fairness, constitutional integrity, and moral uprightness,will prevail. Our collective respect for this process will strengthen our democracy and renew our unity and resolve to defend Sabah’s sovereignty and rights with courage and conviction.
