{"id":7669,"date":"2021-11-03T23:12:18","date_gmt":"2021-11-03T15:12:18","guid":{"rendered":"https:\/\/jesseltontimes.com\/wpmarch2025\/?p=7669"},"modified":"2021-11-03T23:12:18","modified_gmt":"2021-11-03T15:12:18","slug":"lifting-of-emergency-sarawak-state-assembly-automatically-dissolved-experts","status":"publish","type":"post","link":"https:\/\/jesseltontimes.com\/wpmarch2025\/2021\/11\/03\/lifting-of-emergency-sarawak-state-assembly-automatically-dissolved-experts\/","title":{"rendered":"Lifting of Emergency: Sarawak State Assembly automatically dissolved &#8211; Experts"},"content":{"rendered":"<p>&nbsp;<\/p>\n<p>KUALA LUMPUR: Speculation on the dissolution of the Sarawak State Legislative Assembly which has been swirling since last week became\u00a0a reality after Yang di-Pertuan Agong\u00a0Al-Sultan Abdullah Ri&#8217;ayatuddin Al-Mustafa Billah Shah today consented to the lifting of the\u00a0Proclamation of Emergency for Sarawak.<br \/>\nIn a statement,\u00a0Istana Negara said\u00a0Al-Sultan Abdullah\u00a0gave the consent after granting an audience to Sarawak Yang Dipertua Negeri\u00a0Tun Abdul Taib Mahmud\u00a0at Istana Negara yesterday to discuss the state\u2019s application for the Emergency Proclamation to be lifted.<br \/>\nCommenting on the matter, constitutional expert Associate Professor\u00a0Dr Khairil Azmin Mokhtar said this meant that the Sarawak state government was\u00a0automatically dissolved on reaching its full term and that a state\u00a0 election has to be held.<br \/>\n&#8220;When the Proclamation of Emergency is\u00a0lifted and the Emergency Ordinance repealed, the Sarawak State Legislative Assembly is then dissolved.<br \/>\n\u2018\u2019According to Article 21 of the Sarawak State Constitution, when the state assembly is dissolved, a state election has to be held within 60 days of the date of dissolution of the assembly and a meeting of the new assembly has to be convened not later than 120 days from this date,\u201d he told Benama.<br \/>\nOn July 31 this year, Al-Sultan Abdullah consented to the Proclamation of Emergency for the whole of Sarawak beginning Aug 2 until Feb\u00a02 next year, effectively suspending the holding of the state election during this period.<br \/>\nAccording to Clause (3) Article 21 of the State Constitution, the State Legislative Assembly should have been dissolved on June 7, but the Clause had\u00a0no effect as\u00a0Paragraph 15(1)(a) of the Emergency (Essential Powers) Ordinance\u00a02021 has suspended\u00a0the dissolution of the state assembly.<br \/>\nHowever, Section\u00a02(2) of the Emergency (Essential Powers) (Sarawak) Ordinance 2021 promulgated following the Emergency Proclamation for Sarawak stated that the Yang di-Pertuan Agong can lift the proclamation earlier after discussion with the\u00a0Yang Dipertua Negeri.<br \/>\nMeanwhile, International Islamic University\u00a0Malaysia law lecturer Prof Dr Nik Ahmad Kamal Nik Mahmood said there was no need for Tun Abdul Taib to announce the dissolution of the state assembly as the state government had already completed its five-year term and a state election should be held.<br \/>\n\u201cThere is no need for the TYT (Yang Dipertua Negeri) to announce the dissolution of the state assembly because it has\u00a0been dissolved.<br \/>\n\u201cThe action that can be taken now is to inform the Speaker (of Sarawak State Assembly) and Election Commission that the state assembly has been dissolved so that a state election can be held within 60 days,\u201d he added.<br \/>\n&#8212; BERNAMA<\/p>\n","protected":false},"excerpt":{"rendered":"<p>&nbsp; KUALA LUMPUR: Speculation on the dissolution of the Sarawak State Legislative Assembly which has been swirling since last week became\u00a0a reality after Yang di-Pertuan Agong\u00a0Al-Sultan Abdullah Ri&#8217;ayatuddin Al-Mustafa Billah Shah today consented to the lifting of the\u00a0Proclamation of Emergency for Sarawak.
